We are told that if a Veteran joins the military and are active duty they are eligible for disability benefits. When the VA determines a Veterans disability is Willful Misconduct, the Veteran will not receive any money. ➡️The benefit of the doubt is the rules set in place by congress that are applied for VA disability benefits. If a Veteran is in between two ratings with their symptoms, the VA has to use the higher of the two ratings. The biggest example of how benefit of the doubt is applied in disability cases is the burden of proof. The burden of proof for disability claims is at least as likely as not, meaning just a 50% that the condition is linked to service will win service connection.
